Indefinite Leave to Remain in the UK

What is Indefinite Leave to Remain/Permanent Residence?

Indefinite Leave to Remain/Permanent Residence is an immigration status given to a someone that previously only had temporary residence in the UK. It enables that person to stay in the UK for an unlimited period. This visa status is for someone who plans to settle and make the UK his/her permanent home. A non-EEA individual with ILR (Indefinite Leave to Remain) has full rights to employment (including self-employment), studying with no restriction without resorting to public funds.

Why Apply for Indefinite Leave to Remain?

  • Unlike work permits and other visas, if you have indefinite leave to remain you no longer have to apply for Visa Extensions.
  • You do not have a time limit to live/work in the UK.
  • No given restrictions to type of work, business or education.
  • ILR can lead to UK citizenship after just 1 year.

Indefinite Leave to Remain Eligibility

For a person to become eligible for ILR/Permanent Residency he/she must have a settled position in the UK for at least a certain amount of time. The minimum number of years a person must have been in the UK in order to become eligible depends on the type of visa they have been on. Whichever visa the person has been in the UK on, it must have been continually valid for whole period.
  • Work permit holder for 5 Years.
  • Highly Skilled Migrant Programme (HSMP) for 5 Years.
  • Married or Unmarried partners for 2 years.
  • UK Ancestry for 5 Years.
  • Investors for 5 Years.
  • Writers, composers and artists for 5 Years.
  • EEA Dependants for 5 Years.
  • Business Person for 5 Years.
  • Sole repetitive for 5 Year.
  • Long Residency (continuous lawful residence) for 10 Years.
  • Long Residency (continuous lawful or unlawful residence) for 14 Years.
Anyone applying for ILR/permanent residency will also need to take and pass the Life in the UK test or achieve an ESOL (English for Speakers of Other Languages) qualification.

Indefinite leave to remain Conditions

Please note ILR/Permanent residency can be revoked if a person exceeds more than 2 years outside of the UK. iEffect will ensure you follow the correct application procedures, making sure the correct supporting documentation is in place and will follow your switching application through to completion.
